This Privacy Policy applies to the Chef Marketplace online platform, operated by Chef Marketplace, Corso Venezia 43, 37047 San Bonifacio, Italy (“CM”);

We take our users' privacy very seriously. All data will be collected, stored and used in accordance with the General Data Protection Regulation of the European Union n. 2016/679 ("GDPR") or other legal provisions.

The services offered by us through the Website and/or the App (together, the "Platform") are available only through the collection, storage, transfer, deletion and/or other use ("collection and use") of specific data relating to you ("personal data" or "data"). Personal data means any information relating to an identified or identifiable natural person, such as name, address, email address, telephone number.

Some services on our Platform are offered by third party providers. Under applicable data protection laws, Chef Marketplace is obliged to inform you about the processing of your data and Chef Marketplace fulfills this obligation through this Privacy Policy. This Privacy Policy and any part of it are not intended as contractual clauses and do not form part of the Terms and Conditions of Use for Users ("TC") which constitute a contract concluded with registered users. Based on applicable data protection laws, Chef Marketplace may process the data necessary for the execution of a contract with the user or for the implementation of measures at the request of the user before concluding a contract (art. 6 (1) (b) GDPR). References to the TCs must always be understood as information on data processing (art. 13 and 14 GDPR) and never as clauses that are part of the TCs. Through the use of the Platform and our services, the user enters into a legally binding contract with Chef Marketplace, the conditions of which are described in the TC.

Platform Users can have the following profiles.

Individual: physical person.

Restaurateur: legal person belonging to the Restaurateur category (available at https://chefmarket.place/restaurateurs-categories/ ).

Seller: legal person who sells products and services to the Restaurateur.

Customer User: natural or legal person who buys on Chef Marketplace.

Supplier User: legal person who sells on the Chef Marketplace.

2.   Why and how do we collect and use user data?

The legal basis for the collection and use of the data is the performance of a contract (TC) to which the user is a party or the taking of measures, at the request of the user, before entering into a contract (TC ) (Article 6 (1) of the GDPR).

Chef Marketplace collects user data to allow you to use our Platform, to provide our services and fulfill the contract (TC) stipulated with the user himself

2.1. To allow users to use the Platform, allow us to provide the services and implement the TCs

We collect and use your data to allow you to use our Platform, provide you with our services, fulfill the contract (TC) with the user and above all to undertake commercial transactions through the Platform, use the electronic payment system or allow leave reviews and communicate with other users. 3.   Recipients of the data

We perform technical maintenance activities and constantly improve the Platform to protect the security and privacy of the data we process and to perform certain business functions that help make our services available and functional. For this reason, we transfer user profile data to providers who provide us with cloud and hosting services, IT security, maintenance and technical services, communication services:

Apple Distribution International (Ireland), Apple Inc. (USA) (data is protected due to the adherence of the service provider to the EU Model Contractual Clauses for data transfers in a manner approved by the European Commission); We transfer data to lawyers, paralegals, notaries, bailiffs, auditors, consultants, IT service providers, archiving services who provide services to us.

We are legally required to provide data and/or usage data to investigative, criminal or supervisory authorities if and to the extent necessary to avoid risk to the public and to prosecute criminal acts.

4.   What does a user need to know when interacting with a Supplier User?

Joint ownership of Chef Marketplace and the Supplier User – Essential aspects of the agreement

 

The data of the Customer User collected for the specific purpose will be data processed jointly by Chef Marketplace and by the Supplier User. The Customer User is informed of the fact that Chef Marketplace and the Supplier Users process the data as "joint data controllers". This means that Chef Marketplace and Supplier Users are jointly responsible for fulfilling certain legal obligations when they process data as joint data controllers. Not all data processing involves joint ownership, but only those relating to specific purposes and at certain stages of the processing, as explained in more detail in the individual sections of this Privacy Policy (see 2.1, 2.5, 2.6, 2.8 )

In this section, we want to inform the user about the essential aspects of the joint responsibility agreement that Chef Marketplace has signed with the Supplier Users, pursuant to art. 26 (2) paragraph 2 of the GDPR. As there are two data controllers, we wish to explain the responsibilities of each.

In general, Chef Marketplace and Supplier Users are both responsible for fulfilling the legal obligations set out in the GDPR. Nonetheless, Chef Marketplace and the Supplier Users have agreed on specific responsibilities that apply when they act as joint data controllers. Chef Marketplace is responsible for:

  • act as a point of contact (art. 26 (1) paragraph 3 of the GDPR) for the Customer User;
  • manage centralized communications with the Customer User regarding the rights of the interested party (Article 15 of the GDPR, Article 16 of the GDPR, Article 17 of the GDPR, Article 18 of the GDPR, Article 20 of the GDPR);
  • provide the User with information on data processing (art. 13 of the GDPR and art. 14 of the GDPR);
  • inform the User Client about the essential aspects of the agreement (art. 26 (2) paragraph 2 of the GDPR), an obligation he fulfills in this section;
  • informing the User Client about data breaches involving a high risk for his rights and freedoms (Article 34 (1) of the GDPR), in the event that such a breach occurs.
  • be informed about the data we collect and use and request access or request a copy of the data in question (right of access). Any data that you have actively provided to us on the Platform is also accessible by you at any time in your Chef Marketplace account;
  • request the correction of inaccurate data and, depending on the nature of the collection and use, the completion of incomplete data (right to rectification). All data that the user has actively provided to us on the Platform can also be modified by the user at any time in his Chef Marketplace account (with the exception of messages sent and any posts or reviews in the forum);
  • in the presence of just cause, request the cancellation of data (right to cancellation);
  • request the limitation of the collection and use of data, provided that the legal criteria are met (right to limit processing);
  • receive, subject to compliance with regulatory criteria, the data provided in a structured, updated and machine-readable form and transfer such data to another data controller or, where technically feasible, have them transferred by Chef Marketplace (right to data portability );
  • not be subject to decisions based solely on automated processing, including profiling, which produce legal or otherwise significant effects on the user, unless the legal conditions for such automated decision-making are met;
  • object to the collection and use of data – only where the collection and use are based on an activity carried out in the public interest or in the exercise of an official authority (art. 6 (1)(e) of the GDPR) or legitimate interest (art. 6 (1)(f) of the GDPR), including profiling, based on the same reasons for the collection and use of data explained in other sections of this information (right to object). You also have the right to object at any time to the collection of your data for direct marketing purposes;
  • to revoke the consent given at any time. Such revocation will not affect the legality of the data collection and use activities carried out prior to the revocation and based on the authorization granted. All other responsibilities provided for by the GDPR are fulfilled by both Chef Marketplace and the Supplier Users. In most cases, these other duties do not directly involve the Customer User as a data subject, but are instead general obligations of the joint controllers, such as for example the maintenance of security measures and a register of processing activities. For the processing of data that goes beyond the scope of the shared ownership, both Chef Marketplace and the Supplier Users are independently and separately responsible and the information provided in this section does not apply.

As we are constantly developing our services, we reserve the right to modify this Privacy Policy at any time, in accordance with applicable regulations. Any changes will be published promptly on this page. Regardless of the above, you should check this page regularly for any updates.

7.   Your legal rights in relation to your data
